§1 Key Information
1. In this Reviews Policy, you will find the rules regarding the publication and verification of Reviews by Maryla Denka, conducting business activity under the name Maryla Denka (operating under the brand: Swedishness), Tax Identification Number (NIP) 9512455754, REGON 369494772, address: Husarii 29, 02-951 Warsaw (hereinafter referred to as the “Website Owner”). Fast and direct communication is available via email at: maryla@swedishness.se, which also serves as the point of contact for direct communication with the authorities of Member States, the Commission, the Digital Services Board, as well as with Users using the Website.
3. The purpose of this Reviews Policy is to provide you with reliable information regarding the rules for publishing and verifying Reviews, which may help you make informed purchasing decisions.
4. We publish reviews from persons who have purchased or used our products and services (hereinafter referred to as the “Clients”), i.e.:
1) persons who have purchased a Product,
2) persons who have entered into a service agreement or another civil law agreement,
3) persons who have used, either free of charge or for a fee, a Product or service of the Website Owner.
§2 Rules for Review Verification
1. The verification of Reviews (hereinafter also referred to as “User Content”) is a key element in building trust and credibility.
2. Review verification consists of checking whether the reviewing person has purchased or used our products and services, and whether the Review does not violate applicable laws or accepted standards of conduct, and complies with the Reviews Policy as well as the User Content Moderation rules in accordance with the Website Terms and Conditions.
3. Where the Terms and Conditions provide that Reviews are verified, the verification of Reviews is carried out in accordance with the rules set out below.
4. The verification of Reviews by the Website Owner is carried out, among others, by:
1) comparing personal data with the data and information held regarding Clients or persons who have used the Products and services of the Website Owner to date,
2) comparing the details of the cooperation with the data and information held regarding Clients or persons who have used the Products and services of the Website Owner to date,
3) direct contact with the reviewing person after the submission of the Review (e.g. thanking them for the Review),
4) direct contact with the reviewing person with a request to leave a Review,
5) obtaining a Client’s review through direct communication with the Client (e.g. through email correspondence conducted in connection with the cooperation),
6) sending Clients a dedicated link for leaving a Review.
5. Where a Review is published independently by:
1) the Website Owner, the Review is verified by the Website Owner prior to its publication,
2) the reviewing person, the Review is verified by the Website Owner immediately after its publication by the reviewing person.
6. If a Review does not comply with the rules of the Reviews Policy or raises doubts as to whether the Review originates from a Client, such Review is not published by the Website Owner, and if it has been published independently by the reviewing person, it shall be promptly removed by the Website Owner.
7. A Review may be withheld from publication, and a published Review may be blocked and become unavailable to other Users, removed from the Website, or otherwise have its visibility restricted if the Review is contrary to applicable law, accepted standards of conduct, or is considered illegal Content within the meaning of the Digital Services Act, including where it:
1) is of a terrorist nature;
2) violates the law or good morals;
3) constitutes SPAM or is repeatedly published on the Service without justified purpose;
4) is offensive, contains expressions considered hate speech, threats, incitement to or glorification of violence, harassment, racism, discrimination, or defamation;
5) infringes or restricts third-party rights, particularly the right to privacy, image rights, data protection rights, trademarks, or copyright;
6) serves to conduct competing activities or constitutes an act of unfair competition;
7) constitutes unauthorized advertising, promotion, or marketing activities;
8) serves to conduct activities prohibited by law, such as financial fraud;
9) promotes fascist or other totalitarian regimes;
10) defames or insults any person;
11) infringes on the personal rights of any individual;
12) includes vulgar or otherwise offensive content;
13) insults religious feelings;
14) contains false statements regarding the facts or the factual circumstances described, or relates to products or services that are no longer offered by the Website Owner.
8. Where any of the actions referred to above are taken, the Website Owner shall promptly notify the User who submitted the User Content, providing the reasons for the decision. The User may appeal against such decision in accordance with the procedure set out in §4 of this Reviews Policy. The Website Owner is responsible for verifying the legitimacy of the actions taken in relation to the User Content.
9. The Website Owner shall not be liable for User Content made available on the Website, provided that the Website Owner:
a) has no actual knowledge of illegal activity or illegal User Content, and, with regard to claims for damages, is not aware of facts or circumstances from which the illegal activity or illegal User Content is apparent; or
b) upon obtaining such knowledge or awareness, acts expeditiously to remove or disable access to the illegal User Content, or otherwise restricts its visibility or monetisation.
10. The Website Owner shall notify the competent authorities/law enforcement authorities where the Website Owner has reason to believe that a User has committed, is committing, or is likely to commit a criminal offence involving a threat to the life or safety of one or more persons, and shall provide all available information relating thereto.
§3 Rules for Publishing Reviews
1. Reviews on the Website
1) Reviews published on the Website Owner’s website are verified by the Website Owner in accordance with the Review verification rules set out in §2 of the Reviews Policy.
2) The published Reviews are intended to present the benefits associated with using the products and services of the Website Owner, as identified by Clients to date.
3) Reviews are published independently by the Website Owner.
4) The Website Owner does not use sponsored Reviews.
2. Reviews on Instagram
1) Reviews published on the Instagram account of the Website Owner are verified by the Website Owner in accordance with the Review verification rules set out in §2 of the Reviews Policy.
2) The published Reviews are intended to present the benefits associated with using the products and services of the Website Owner, as identified by Clients to date.
3) Reviews are published independently by the Website Owner.
4) The Website Owner does not use sponsored Reviews.
3. Reviews on Facebook
1) Where Reviews are published independently by the Website Owner on its fanpage for the purpose of presenting the benefits associated with using the products and services of the Website Owner, such Reviews are verified by the Website Owner in accordance with the rules set out in §2 of the Reviews Policy.
2) In addition, the Website Owner allows Users of the Facebook platform to add Reviews using the “REVIEWS” functionality made available on the platform. In such cases, all Reviews, both positive and negative, are published.
3) As the rules for publishing Reviews using the “REVIEWS” functionality are governed by the Facebook Community Standards [LINK], and the Website Owner has no influence over them. Reviews published independently by Users on the Facebook platform are not verified by the Website Owner. Regardless of this, where such Reviews violate the Facebook Community Standards, the Website Owner shall take steps to report the violation in accordance with the procedure provided for on the Platform.
4) The Website Owner does not use sponsored Reviews.
§4 Reporting Prohibited Content and Appealing the Website Owner’s Decision
1. Anyone may report to the Website Owner any User Content that they consider to constitute Illegal Content within the meaning of the Digital Services Act (DSA).
2. A report may be submitted by email to maryla@swedishness.se, including by using the form provided as Annex 1 to this Reviews Policy.
3. The report referred to in paragraph 1 should contain:
1) a reasoned explanation of the grounds on which the person or entity submitting the report considers the User Content to be in breach of the Terms and Conditions;
2) an indication of the exact electronic location of the information, such as the exact URL, as well as any additional information enabling the identification of the User Content, as appropriate to the type of User Content and the specific type of hosting service;
3) the name or business name and email address of the person or entity submitting the report, except in the case of a report concerning information considered to be related to one of the offences referred to in Articles 3-7 of Directive 2011/93/EU;
4) a statement confirming that the person or entity submitting the report has a good-faith belief that the information and allegations contained therein are accurate and complete.
4. Where the Website Owner has not blocked or removed User Content or restricted its visibility despite a report submitted by another User or a third party, or has failed to take the above-mentioned actions despite there being grounds to do so, or has taken other actions referred to in the Reviews Policy, an appeal against the Website Owner’s decision may be submitted by the User who provided the User Content or by the person who reported the User Content. An appeal may be submitted by email to: maryla@swedishness.se. The appeal should contain the information necessary for its consideration, including, in particular, the identifying and contact details of the User submitting the appeal and a detailed justification indicating the deficiencies in the Website Owner’s decision.

The Reviews Policy is protected by copyright. Copying or distributing the Reviews Policy without the
consent of the Website Owner is prohibited and may result in both criminal and civil liability.
